1. This Regulation defines the general conditions, rules, and the manner of providing: a. the Service Order for the rental Service; b. Services provided electronically, e.g., newsletter, sending messages via the contact form through the inarent.pl website (hereinafter referred to as the Internet Service), by the company conducting business under the name INA MANAGEMENT SP. Z O.O., registered in the Register of Entrepreneurs maintained by the District Court for the city of Gdańsk, 7th Commercial Division of the National Court Register under KRS number 0000743606, at the address: ul. Jana Heweliusza 9, 80-890 Gdańsk, NIP: 5833317195, hereinafter referred to as INA Rent.
  2. Contact with INA Rent can be made via: a. traditional mail at: ul. Jana Heweliusza 9, 80-890 Gdańsk; b. email at: KONTAKT@INARENT.PL; c. telephone: +4858 38 002 38; d. via the contact form available on the Service.
  3. This Regulation is continuously and freely made available by INA Rent on the website inarent.pl, in a manner enabling Clients to acquire, reproduce, and save its contents by printing or saving on any medium at any time using the Client's IT system.
  4. All rights to the Internet Service, including property copyrights, intellectual property rights to its name, domain, website of the Service, as well as to forms, logos, and all content published and made available within the Service belong to INA Rent, and their use may only take place in the manner defined and consistent with the Regulation.
  5. INA Rent informs that using electronic Services may involve a risk for every Internet user, such as the possibility of introducing harmful software into the Client's IT system and unauthorized persons acquiring and modifying their data. To avoid the risk of the above threats, the Client should apply appropriate technical measures to minimize their occurrence, especially antivirus programs and firewall protection.

Definitions

Terms used in this document have the following meanings:

  • Tourist voucher - Polish Tourist Voucher within the meaning of the Act of July 15, 2020, on the Polish Tourist Voucher (Journal of Laws 2021, item 839 as amended);
  • Working days - days from Monday to Friday excluding public holidays;
  • Availability - means that the Room or Apartment is free and the Client may rent the Room or Apartment from INA Rent on the date chosen by the Client;
  • Calendar - using the Calendar, the Client can check the Availability of the Room or Apartment;
  • Client - a natural person with full legal capacity, as well as a natural person conducting business activity, a legal person, or an organizational unit without legal personality who may use the Services available in the Service;
  • Civil Code - Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);
  • Consumer - a Client who is a consumer within the meaning of Article 22[1] of the Civil Code;
  • Entrepreneur - a Client who is an entrepreneur within the meaning of Article 43[1] of the Civil Code;
  • Room or Apartment - a room or residential unit described in the Service, which may be rented by the Client;
  • Reception - point of receiving Clients by INA Rent at the addresses:

  • Regulation - this document;
  • Facility Regulations - a document created by INA Rent, available for review at the Facility Reception; regulates the rules for using the Room or Apartment and Client's liability for non-compliance with these rules; the Facility Regulation is an annex to this Regulation;
  • Internet Service/Service - the internet service available at the inarent.pl domain, owned and administered by INA Rent, through which Clients conclude rental Agreements and agreements for the provision of electronic services;
  • Rental Agreement (Rental Agreement/Hire) - Agreement under which INA Rent leases a Room or Apartment to the Client for a fee, for the term indicated by the Client when placing the Order, under the conditions set out in this Regulation in the chapter titled "VIII. Rules for Concluding the Rental Agreement";
  • Services - services provided electronically by INA Rent to Clients within the meaning of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204 as amended);
  • Additional services - services other than Rental provided by INA Rent to Clients, whose scope and price are listed on the Service pages; Consumer Rights Act – Act of May 30, 2014, on consumer rights (Journal of Laws 2014, No. 827);
  • Act on the provision of electronic services - Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204 as amended); Voucher - a document in PDF format containing a code entitling the use of the amount specified in the document as a means of payment for Rental in the Service or for the performance of the service by INA Rent described in the Voucher for the person who holds it, under the conditions specified in this Regulation;
  • Check-in - registration of the Client in the Room or Apartment, taking place at the Reception by filling out check-in forms prepared by INA Rent and handing over keys to the Room or Apartment; Order - the Client's declaration of intent directly aimed at concluding a Rental Agreement with INA Rent, under the terms specified in the Regulation, in the chapter titled "VII. Rules for Concluding the Rental Agreement";

Rules for using the service

  1. INA Rent, through the Service, enables Clients to use the Services it provides.
  2. Use of the Service may only be made under the conditions and scope indicated in the Regulation and in accordance with applicable law.
  3. Minimum technical requirements to use the Service: device with Internet access, access to email, latest internet browser version with Cookies and Java Script enabled, software to read and save PDF files.
  4. It is prohibited for the Client to use the Service or Services in a way that violates the law, good manners, personal rights of third parties, or justified interests of INA Rent, especially providing unlawful content.

Services

  1. Services are provided under the terms specified in this document.
  2. INA Rent provides the following free Services: a. browsing information posted on the Service, b. using the form allowing Clients to contact INA Rent, c. redirecting to external social media, d. sharing the Calendar, e. providing the Newsletter Service, as well as paid Rental, Voucher, and Additional Services.
  3. Conditions for concluding and terminating agreements for the provision of Services are specified in the Regulation in the subsections below.
  4. An agreement for the provision of the Service consisting of browsing information posted on the Service is concluded for a fixed term and terminates when the Client closes the Service webpage.
  5. The Client can send a message to INA Rent via the form available in the Service. The agreement for providing the contact form service is concluded for a fixed term and terminates upon sending the message by the Client via the form.
  6. The agreement for providing the service redirecting to external social media such as Facebook, Instagram, and Linkedin is concluded for a fixed term and terminates upon clicking the button with the respective service icon.
  7. The agreement for providing the Calendar sharing service is concluded for a fixed term and terminates upon clicking the dedicated button.
  8. The Client may receive commercial information from INA Rent in messages sent to the email address provided by the User (Newsletter Service). A valid email address must be provided for this purpose. The Client may withdraw consent to receive commercial information at any time. The newsletter is sent only to Clients who have subscribed.
  9. INA Rent has the right to organize occasional contests and promotional campaigns, the conditions of which will be provided each time on the website of the Service. Promotions in the Service may not be combined unless otherwise stated in the specific promotion's terms.

Rental service

  1. INA Rent enables concluding a Rental Agreement through the Service.
  2. INA Rent provides the Rental Service based on this Regulation and the Facility Regulations.
  3. Information on Rooms or Apartments on the website, especially their descriptions, parameters, prices, constitute an invitation to conclude an Agreement within the meaning of Article 71 of the Civil Code. Some invitations may be marked as "Special Offers."
  4. In case of Special Offers, INA Rent excludes the possibility of making changes in the Rental scope.
  5. The Client is obliged to pay the Fee for the provision of the Rental Service.
  6. The fee is payable in advance within the term indicated on the Internet Service pages during Order placement.
  7. INA Rent may require the Client to pay a deposit in the amount indicated during Order placement within 24 hours from placing the Order.
  8. The deposit paid by the Client is credited towards the Fee.

Deposit

  1. INA Rent may require the Client to pay a security deposit of 500 PLN (hereinafter: "Deposit"). The Deposit secures INA Rent's claims under the Rental Agreement and covers potential contractual penalties for non-compliance with Facility Regulations.
  2. The Deposit is secured by INA Rent through credit card pre-authorization, i.e., at payment, funds are temporarily blocked up to the amount indicated on the Service's websites for later payment confirmation and settlement.
  3. In exceptional cases, INA Rent may agree with the Client on Deposit payment via traditional bank transfer.
  4. Settlement of payment occurs within 4 days from the end of the Rental Agreement after deducting any claims due to INA Rent. Before deduction, INA Rent will inform the Client in writing or via email about the event causing the deduction and the amount deducted.

Voucher

  1. INA Rent allows purchasing Vouchers via the Service.
  2. Information about Vouchers on the website, especially their descriptions, technical and usage parameters, and prices, constitute an invitation to conclude an Agreement within the meaning of Article 71 of the Civil Code.
  3. Rules for concluding the Agreement are regulated in this Regulation under point VII titled "Concluding the Agreement for the provision of Rental Service or Voucher."
  4. Vouchers are sent to the Client via email.
  5. The Voucher can be redeemed within one year from the Order placement date.
  6. INA Rent is the sole issuer of Vouchers.
  7. The Voucher cannot be exchanged for cash.

Concluding the rental agreement and the service voucher agreement

  1. INA Rent enables concluding a Rental Agreement for a Room or Apartment or the Agreement for Voucher services through the Service, according to the information presented on the Service.
  2. The Rental Agreement can be concluded by a natural person aged 18 or older with full legal capacity and by an Entrepreneur.
  3. INA Rent presents information on Rooms or Apartments on the Service website, including the number of persons for which the Room or Apartment can be rented, and provides a Calendar to check availability and price of individual Rooms or Apartments.
  4. To place an Order, the Client after checking availability with the Calendar, chooses a Room or Apartment to rent, selects additional services via checkboxes, then places the Order through the Order form on the Service website.
  5. The Client may also place an Order for a Voucher service using the Calendar, selecting the type of Voucher to order, then submitting the Order via the form on the website.
  6. The Order submitted to INA Rent electronically constitutes an offer to conclude the Rental or Voucher Service Agreement subject to the Order.
  7. The Order form is handled by INA Rent's IT provider, Profitroom S.A., based in Poznań, ul. Roosevelta 9, 60-829 Poznań, registered in the National Court Register under KRS 0000793213; NIP: 525-24-23-458; REGON: 141374990.
  8. An electronic offer binds the Client once INA Rent sends the Order confirmation to the Client's email address.
  9. The Agreement is concluded upon payment of the deposit or full Fee for the Rental or Voucher Service, depending on the type of Order.
  10. The Client may also place an Order for Rental or Voucher via email.
  11. Placing an Order via email is possible during working days and hours specified on the Service website. The Client should: a) indicate in the email the type of Voucher or Room/Apartment, number of persons or animals using the Room/Apartment during the Rental, additional services desired; b) provide information necessary for Order execution, especially name, residence, email, payment card number; c) inform about VAT invoice requirements and provide all necessary data requested by INA Rent.
  12. The total Order value is always provided by INA Rent via email with information that concluding the Rental or Voucher Service Agreement is binding.
  13. For Clients who are Consumers, INA Rent sends Order confirmation and payment obligation after ordering via email.
  14. The Agreement is concluded upon deposit payment, but for Special Offers and Voucher, upon payment of the full Fee.
  15. After concluding the Rental or Voucher Service Agreement, INA Rent confirms the terms by sending them to the Consumer's email or mailing address.
  16. The Rental or Voucher Service Agreement is concluded in Polish, consistent with the Regulation.

Payments

  1. All payments the Client must make under the Rental Agreement or Voucher Service Agreement are given in Polish zlotys including all components, including VAT.
  2. The Client may pay via: a. bank transfer to INA Rent's bank account specified on the Service (order execution starts after INA Rent sends confirmation and funds clear); b. electronic payment via the payment system integrated with the Service (rental is possible after INA Rent receives payment notification from the payment agent system); c. Tourist voucher.
  3. The Client must pay the deposit within 24 hours of placing the Order.
  4. If the deposit is not paid within this period, the Agreement is considered not concluded.
  5. For Orders requiring a deposit, the Client may pay the remaining Fee in cash no later than on the Rental start day, unless INA Rent agreed to defer payment.
  6. If the Client avoids paying the remaining Fee after paying the deposit, INA Rent may refuse check-in.

Rental agreement changes

  1. INA Rent allows the Client to make changes to the Rental Service no later than 5 days before the Rental start date.
  2. For Special Offers, the Client may not make changes to the Rental Service.
  3. The Client contacts INA Rent via email specifying the requested changes to the Rental Agreement or INA Rent's electronic system for concluding the Rental Agreement.
  4. INA Rent, after checking availability within 2 days of receiving the change request, informs the Client via email whether the change was made.
  5. If due to lack of availability INA Rent cannot make the change, it allows the Client to withdraw from the Rental Agreement. In this case, the contractual withdrawal provisions of this Regulation apply.

Contract withdrawal

  1. A Client who is a Consumer has the right to withdraw from the Agreement within 14 days from its conclusion without giving reasons by submitting a relevant statement to INA Rent. The Client may draft the statement independently or use the template available on the Service website (statutory right to withdraw).
  2. INA Rent, upon receiving the withdrawal statement, sends the Consumer a confirmation of receipt via email.
  3. According to the Consumer Rights Act, the right to withdraw is excluded in cases including: a. Service agreements where INA Rent fully performed the service with the Consumer's explicit consent and prior information that withdrawal is lost upon full performance; b. service agreements for accommodation other than for residential purposes, transport of goods, car rental, catering, leisure, entertainment, sports, or cultural events if the date or period of service is specified in the contract.
  4. The right to withdraw is also excluded in other cases specified in Article 38 of the Consumer Rights Act.
  5. The statutory right to withdraw does not apply to Rental Agreements.
  6. The Client may withdraw from the Rental Agreement no later than 14 days before the Rental start date (contractual right to withdraw).
  7. If the Client exercises the contractual right to withdraw, the deposit or Fee paid is refunded within 7 days from withdrawal using the same payment method unless the Client agrees to another method.
  8. The Client may also withdraw later than 5 days before the Rental start but no later than 16:00 on the Rental start day. In this case, INA Rent retains the deposit.
  9. The contractual right to withdraw is excluded for Special Offers and after 16:00 on the Rental start day.

Clients' rights and obligations

  1. Every Client of the Service is obliged to: a. use the Service lawfully, in good manners, and according to the Regulation, respecting personal rights and intellectual property of third parties; b. provide accurate data and immediately inform INA Rent of any changes; c. not use devices, software, or methods that could disrupt the Service; d. refrain from delivering unlawful content.
  2. Clients and persons they allow to use the Room or Apartment must comply with Facility Regulations.
  3. The Client must check in as indicated by INA Rent no later than on the Rental start date. After individual agreement, a later check-in is possible.
  4. If the Client refuses to check in within the specified period, INA Rent may terminate the Rental Agreement without notice.
  5. The Client may not engage in activities burdening other Clients' or INA Rent's mailboxes, especially sending advertising messages.
  6. Clients who are Consumers have options for out-of-court dispute resolution: a. they can appeal to the permanent consumer arbitration court at the Trade Inspection; b. appeal to the provincial trade inspector for mediation; c. obtain free assistance from the county (municipal) consumer advocate or social organizations protecting consumers (e.g., Federation of Consumers, Polish Consumer Association); help is provided by Federation of Consumers at the free hotline 800 007 707 and Polish Consumer Association at porady@dlakonsumentow.pl; d. submit complaints through the EU ODR platform at http://ec.europa.eu/consumers/odr/.

Client liability under rental agreement

  1. The Client agrees to leave the Room or Apartment on the last day indicated in the Rental Agreement by 10:00 AM.
  2. The Room or Apartment with all keys must be returned to INA Rent in unchanged condition.
  3. In case of lost keys, the Client shall pay a contractual penalty of 350 PLN.
  4. The Client is responsible for damages caused by themselves or persons staying with them in the Room or Apartment.
  5. If damage is found, INA Rent may deduct the amount of the damage from the Client's Deposit.
  6. Before making a deduction, INA Rent will inform the Client via email about the damage, sending documentation and notifying about the deduction.
  7. INA Rent may terminate the Rental Agreement without notice if the Client grossly or persistently violates the house rules or makes the use of other premises burdensome due to improper behavior.
  8. Gross breaches against house rules include: a. failure to observe night silence; b. subletting or lending the Room or Apartment to third parties; c. exceeding the number of persons allowed during the Agreement; d. non-compliance with Facility Regulations resulting in police or other force intervention.
  9. In such termination cases, INA Rent retains the Fee as a contractual penalty.

Complaints regarding electronically provided services

  1. The Client may submit complaints to INA Rent regarding the operation of the Internet Service and use of Services. Complaints must be submitted in writing to INA MANAGEMENT SP. Z O.O., ul. J. Heweliusz 9, 80-890 Gdańsk, via email: kontakt@inarent.pl or by phone: +48 58 38 002 38.
  2. The complaint must include the Client's name, correspondence address, description and type of problem.
  3. INA Rent undertakes to consider each complaint within 14 days or, if not possible, to inform the Client about the date of consideration. If a complaint is incomplete, INA Rent will request the Client to supplement it within 7 days of receipt of the request.

Personal data protection

  1. Personal data provided by Clients are collected and processed by INA Rent in accordance with applicable law and the Privacy Policy available on the Service website.

Final provisions

  1. The sole source of INA Rent's obligations is this Regulation and mandatory legal provisions.
  2. Provisions concerning Consumers relating to withdrawal and complaints and changes to the Regulation apply to natural persons entering into an agreement directly related to their business activity when the agreement does not have a professional nature arising particularly from the subject of the business activity. The provisions on out-of-court dispute resolution do not apply.
  3. The Regulation is available in Polish.
  4. Reproducing or publishing this Regulation or any part without INA Rent's written consent is prohibited.
  5. Unless mandatory laws state otherwise, Polish law governs dispute resolution under this Regulation.
  6. Disputes between INA Rent and Client as Consumer are subject to courts competent under the Civil Procedure Code.
  7. Disputes between INA Rent and Client as Entrepreneur (excluding natural persons operating single-person businesses whose electronic services and sales agreements relate directly to their business and are not professional) are subject to the court competent by INA Rent’s registered office.
  8. In matters not regulated by this Regulation, provisions of the Civil Code, the Act on electronic services, the Consumer Rights Act, and other applicable Polish laws apply.
  9. This Regulation may be amended. All Consumer Clients will be informed of changes via the Service's main page showing change summaries and effective dates. The effective date will be no less than 14 days after announcement.
